Some are created automatically during the install process and the packages haven't always used force.
This typically happens when folks use new-item without -force typically throws an error if the file already exists. In the past it wasn't as much of a concern because old choco always installed to a new version folder.

installation process and won't be pulled by the nuget package replacement.
