Agreeing to Terms of Use when Logging In without checking "Stay Logged In" Generates Error #3188

Describe the bug
If

A user has created an account
The website adds a terms of use and enables the flag "<enable_login_mustagree_termsofuse>1</enable_login_mustagree_termsofuse>" in the project config.xml file
The user tries to login but does not set the "Stay Logged In" checkbox

then the terms of use page throws an error.

Expected behavior
The user should be able to accept the terms of use and continue.
