Yes, if it's an infrastructure error, the tests would be submitted with MISS status. However, these all are boot tests and their error code and error message suggest that it failed to boot. That's why we are submitting them with FAIL status. For example https://kernelci-api.westus3.cloudapp.azure.com/viewer?node_id=672033fcaaccbda536603e40.
