Although I'm not an expert, I've had MenuMeters (http://www.ragingmenace.com/software/menumeters/) for a very long time. They have had the ability to cmd + drag icons around from the beginning of times. However, it says in the site: "The MenuMeters monitors are true SystemUIServer plugins (also known as Menu Extras). This means they can be reordered using command-drag and remember their positions in the menubar across logins and restarts.".

So my question is, could this be re-factored as a SystemUIServer plugin? Or is it a limitation of AppStore?

yes but faulty code to SystemUIServer could cause instability in a core part of the operating system since it is private/undocumented api

It is built-in macOS Sierra 10.12 now.
