<p>大家也許多少都知道，轉型正義是社會在民主轉型過後，對於過去威權獨裁體制的壓迫所做的善後工作，但何謂壓迫、何謂善後，每個定義與實踐上艱難的題目，我們在試著接近答案的同時，時常就成為答案的一部分。</p>
<p>只有威權時期下的國家權力才能進入轉型正義的討論嗎？還是我們的政府與司法，仍存有威權遺緒而仍待轉型？如果連近年社會運動中發生的國家暴力都無法尋求真相與究責，我們有辦法對抗或處理更遠的威權遺緒嗎？我們沒有模擬考的機會，每次的拋磚引玉與摸索嘗試，都鑿刻下痕跡。</p>
<p>318、324運動這場可以說是現今20歲至30歲這個世代所經歷最大的社會運動，其影響不只是在政治及公民社會。七年後的此刻看來，司法的反應來得疲弱而緩慢，但仍有些漣漪證明當事人與律師團的掙扎並非全然徒勞。</p>
<p>從2020年7月的「威權刑法與轉型正義：從煽惑罪及侮辱公署罪談起」，到2021年4月「佔領運動與言論自由：以公民不服從及抵抗權為核心」兩場研討會，我們邀到了檢、辯、學，橫跨刑事法、公法、國際法與法社會學的觀點，累積了許多討論；2021年3月，我們也辦了一個「查無此人：324行政院暴力驅離事件七週年」特展，把律師團透過訴訟留下來的國家暴力歷史，攤在大眾面前。接下來半年到一年間，我們也將把展品國際化，結合香港與整個東亞抵抗威權的運動，映照人民追求自由民主權利的本質。</p>
<p>從街頭到法庭，從法庭到公民社會，從台灣的公民社會，到整個東亞。我們以這樣的脈絡，節選了三篇近期活動記錄在這期的司思電子報：</p>

<p>324事件後續這些訴訟提醒了我們，縱然是已經民主轉型的國家，追求民主法治的路仍非一帆風順。眾聲喧嘩過後，往往是一連串的遺忘，但記憶的承接者，也參與記憶形塑的工程。當我們參與記憶，我們便留下痕跡，也成為痕跡。</p>

<p>「香港這個地方，代表人權和自由，他是台灣人的希望，彷彿燈塔的存在。」林佳和教授如是說，時空背景是1970年代的台灣人對香港的想法。看過兩年前警察無差別揮動警棍、白衣人追打黑衣遊行人士和日前國安週的新聞畫面，這句話，乍聽之下，確實感覺諷刺，也難以想像當年台灣人視角裡所看到的香港，「竟然是長這樣」。</p>

<p>來過司改會辦公室，大概對於整牆的司改雜誌並不陌生。時光推進，走過司改雜誌中那些過去改革的歲月，我們未曾止步。</p>
<p>隨著司改會投入的工作項目日益增多，攤開現在內部工作會議的議程，光北部辦公室包含法案政策跟個案就共有20個組別，除了司改會這麼多的法律議題、政策、個案之外，我們還希望讓大家看到背後這群相信改革、努力實踐的人們，他們的身影與故事。</p>
<p>適逢疫情期間無法辦實體活動，電子媒介對於訊息的傳播更加重要。於是決定重啟電子報。沒有主編也沒有責編，靠著各個部門在份內事務以外時間抽空帶著志工完成，希望帶給大家軟性的司改之思，給大家更多不同的故事。</p></td>
