ACCC | The ACCC has published the Consumer Data Right compliance review of energy sector data holders' authorisation processes: ACCC observations. The report contains observations from a targeted compliance review into a number of energy sector data holders’ compliance with their authorisation-related obligations as set out in the CDR Rules and Standards. It also includes observations about data holders’ incorporation of best practice Consumer Experience Guidelines (CX Guidelines) into their authorisation processes. We encourage data holders to review the observations in the document to understand the importance of the CX Guidelines for ensuring a consistent and high-quality consumer data sharing experience. | ACCC Report |

2432 | I have read through the other queries and rules around closed accounts but looking for confirmation on the following: Example: Account was closed on 11/10/2022 and API Invocation happened on 11/10/2024. We are not disclosing data from 12/10/2024 and data gets correctly displayed (200) till 10/10/2024. What should happen on 11/10/2024? |
Where a CDR consumer has multiple open accounts with the data holder and closes one of their accounts, the data holder may continue to share data from the closed account if the CDR consumer continues to meet the eligibility criteria set out in rule 1.10B and clause 2.1 of Schedule 3 to the CDR Rules. As you may already be aware, clause 3.2(5) of Schedule 3 to the CDR Rules states the below data is not required consumer data and as such, would be considered voluntary consumer data: - account data that relates to an authorisation on a closed account for direct debit deductions, - if an account was closed no more than 24 months ago – transaction data in relation to a transaction that occurred more than 12 months before the account was closed, and - if an account was closed more than 24 months ago – all account, transaction and product specific data related to the account. If an account was closed on 11/10/2022 (as outlined in your example scenario), we consider the 24-month period would conclude at the end of 10/10/2024. This means on 11/10/2024, the relevant account would have been closed for more than 24 months and account, transaction and product specific data associated with the account is no longer required consumer data. From this time, the data holder may choose whether to disclose all account, transaction and product specific data related to the closed account as voluntary consumer data. Please refer to section 4.4 of the Compliance guide for data holders in the banking sector for further information on required consumer data and voluntary consumer data. |
